The Commission of the Bishops’ Conferences of the European Union (COMECE) expressed concern on October 5, 2026, regarding a legal opinion that could allow individuals to request the erasure of personal data from baptismal registers. The statement follows a non-binding opinion delivered on October 1 by Advocate General Laila Medina of the Court of Justice of the European Union.
The dispute, known as the Bisdom Gent case, began in March 2021 when a Belgian citizen asked the Diocese of Ghent to delete his information from all records, including the baptismal register, citing the General Data Protection Regulation. The diocese instead added a notation stating the person had left the Church and marked the original entry with two diagonal lines.
Medina suggested that EU data protection laws may apply to baptismal records and could grant a baptized person the right to have their information removed if the Church cannot demonstrate compelling legitimate grounds for keeping it. COMECE warned that erasing names would deprive the records of their meaning and purpose, potentially creating significant legal uncertainty for Church authorities across Europe. The final judgment is expected in late 2026 or 2027.
